Para tanto, a partir da revisão da literatura e de documentos, são identificados os elementos que caracterizam essas duas vertentes ideológicas. Em seguida, realiza-se descrição dos paradigmas da situação irregular e dogarantista, com recorte no atendimento socioeducativo, para, após cotejá-los com as vertentes do pensamento criminológico. Ao final, conclui-se que a justiça juvenil é um subsistema do Sistema de Controle Penal, seja orientada pelo paradigma da situação irregular, seja pelo paradigma garantista e tem como suporte o pensamento etiológico e da reação social, respectivamente.The purpose of this research is to study social-educational paradigms targeted at adolescents in conflict with the law, adopting the perspective of the analysis of criminological thoughts, known as etiological and social reaction. Therefore, from the reviews of the literature and the document, it is possible to identify the elements that characterize these two ideological patterns. Next, a description of the paradigms of the irregular situation and the assuring, with emphasis in social-educational service, so that, then, are operating the comparison between the strands of criminological thoughts. At the end, we conclude that the juvenile justice system is a subsystem of the Penal Control System, whether it is guided by the paradigm of the irregular situation, whether it is by the assuring paradigm and, respectively, has the etiological thinking and social reaction as support.Português© MPDFT - Todos os direitos reservados.
