Possibilidade de transação na lei de improbidade administrativa via Ministério Público, A
Abstract
Este estudo acadêmico monográfico tem como finalidade analisar a possibilidade de transação no âmbito da Lei de Improbidade Administrativa - LIA (Lei. n. 8.429/92) via Ministério Público (MP), mesmo diante da perda de eficácia da Medida Provisória n. 703/2015. Ênfase dada aos instrumentos de combate às condutas de improbidades e às de corrupção, especialmente, ao termo de ajustamento de conduta. Buscar-se-á, por meio de revisão bibliográfica normativa e jurisprudencial, demonstrar que, não obstante a vedação aos meios conciliatórios em matéria de improbidade (§1º, art. 17, Lei 8429), o Parquet , órgão permanente e essencial à funcional jurisdicional do Estado, poderá ofertar transação em matéria de improbidade administrativa - sim. Para tanto, analisar-se-á, no primeiro momento, os conceitos e a evolução da norma de combate às condutas ímprobas (LIA), em seguida, a atuação do MP no âmbito do microssistema de combate à Corrupção (Lei de Combate às Organizações Criminosa; Lei anticorrupção e Lei de Improbidade Administrativa), com destaque para sua atuação, judicial e extrajudicial, de caráter transacional (Colaboração premiada, Termo de Ajustamento de Conduta, etc.). Por derradeiro, com intuito de averiguar a verossimilhança da tese ora analisada (possibilidade de oferta de transação pelo MP em matéria de improbidade, mesmo diante da vedação de transação, contida no §1º, art. 17, Lei 8429 ), serão analisados os atos normativos que dispõe acerca da legitimação do MP, no âmbito da improbidade administrativa (Resolução 179 CNMP e Resoluções dos MPs estaduais) (Martins, 2018, p. 4).
The objective of this monographic academic study is to analyze the possibility of a transaction under the Administrative Improbity Law (Law 8,429 / 92) via the Public Prosecution Service (MP), even in the face of the loss of effectiveness of Provisional Measure no. 703/2015. Emphasis is given to the instruments to combat misconduct and corruption, especially to the term of adjustment of conduct. It will be sought, through a normative and jurisprudential bibliographical review, to demonstrate that, despite the prohibition against conciliatory means regarding improbity (§1, article 17, Law 8429), Parquet, a permanent organ essential to the functional jurisdictional of the State, may offer a transaction in matters of administrative improbity. In order to do so, it will be analyzed, in the first moment, the concepts and the evolution of the norm to combat impassable conducts (LIA), then, the performance of the MP in the scope of the microsystem to combat Corruption (Criminal Organization Law; Anti-Corruption Law and Administrative Improbity Law), with emphasis on its judicial and extrajudicial activities, of a transactional character (Prize Collaboration, Term of Adjustment of Conduct, etc.). Lastly, in order to investigate the likelihood of the thesis analyzed herein (possibility of a transaction by the MP regarding misconduct, even before the transaction fence, contained in §1, article 17, Law 8429), the acts will be analyzed (Resolution 179 CNMP and Resolutions of the State MPs) (Martins, 2018, p. 5).
