Reflexões sobre os direitos sociais em tempos de crises econômicas = Reflections on the social rights in times of economic crises

Abstract

O tema deste artigo são os direitos sociais em tempos de crises econômicas. Investigaram-se as restrições desses direitos à luz do texto constitucional. Cogitou-se a hipótese de os direitos sociais estarem intrinsecamente relacionados à dignidade da pessoa humana. Os objetivos específicos foram: analisar a importância dos direitos sociais no escopo constitucional; verificar prováveis justificativas pelas ausências de efetivação; buscar possíveis soluções viáveis. Este trabalho é importante, em uma perspectiva individual, em razão da observância que existe em uma má gestão dos recursos públicos, em detrimento da implementação dos direitos sociais, sob a motivação da reserva do possível. Esse é um tema relevante para a ciência pela mudança de paradigmas; e, para a sociedade, pelos benefícios. Trata-se de uma pesquisa qualitativa teórica com duração de seis meses (Andrade, [2021], p. 1).This article´s theme is ‘social rights in times of economic crises’. The restrictions to these rights were investigated under the light of the brazilian Constitution. The hypothesis was that “social rights are intrinsically related to the dignity of the human being. The specific objectives are: to analyse the importance of social rights in the constitutional scope; to verify the probable justifications for absence of effectiveness; and to investigate the possible viable solutions. This is an important topic for science due to the change of paradigms; and, for society, tor the benefits. It’s a qualitative theoretical research lasting six months (Andrade, [2021], p. 1).
