Abstract
A presente monografia teve por foco principal a análise da "Aplicação da Retroatividade da Lei Penal Benéfica aos Casos Concretos Anteriores à Vigência da Lei que Prevê o Acordo de Não Persecução Penal (ANPP)". Na realização da pesquisa, usou-se o método dedutivo e a metodologia qualitativa de revisão bibliográfica. O trabalho foi subdividido em três capítulos. O primeiro aborda brevemente os aspectos históricos, normativos e legais do ANPP, que surgiu formalmente no ordenamento jurídico pátrio com a promulgação da Lei nº 13.964/2019 ("Pacote Anticrime"), mas que teve origem dois anos antes, no artigo 18 da Resolução nº 181/2017, do Conselho Nacional do Ministério Público (CNMP). No segundo capítulo, o objetivo é esmiuçar o mandamento constitucional contido no art. 5º, inciso XL, da Constituição Federal: "a lei penal não retroagirá, salvo para beneficiar o réu”. Analisando suas implicações e sua incidência efetiva no cenário jurídico pátrio, notadamente nos casos envolvendo lei processual penal hibrida (materialmente penal). No terceiro capítulo, por fim, será feita a análise minuciosa da "Retroatividade Penal Benéfica aos Casos anteriores à vigência da lei que prevê o ANPP – na Doutrina, no Ministério Público (MPF e MPDFT) e na Jurisprudência (TJDFT, STJ e STF)". Indicando ao final, a solução que parece ser a mais acertada para a celeuma, visto estar de acordo com o Ordenamento Jurídico pátrio, notadamente a Constituição Federal vigente, qual seja, deve ocorrer "A Aplicação da Retroatividade da Lei Penal Benéfica nos Casos Concretos Anteriores à Vigência da Lei que Prevê o ANPP, mesmo se já recebida a denúncia ou que já exista sentença transitada em julgado', com fulcro no art. 5º, inciso XL, CF/88 c/c art. 2º, §, parágrafo único, do Código Penal" (Alves, 2022 , p. [7]).
The main focus of this monograph was the analysis of the "'Application of the Retroactivity of the Beneficial Criminal Law to Concrete Cases Prior to the Effectiveness of the Law that Provides for the Criminal Non-Persecution Agreement (ANPP)". In carrying out the research, the deductive method and the qualitative methodology of literature review were used. The work was subdivided into three chapters. The first briefly addresses the historical, normative and legal aspects of the ANPP, which formally emerged in the Brazilian legal system with the enactment of Law No. 181/2017, of the National Council of the Public Ministry (CNMP). In the second chapter, the objective is to scrutinize the constitutional commandment contained in art. 5, item XL, of the Federal Constitution: "the criminal law will not retroact, except to benefit the defendant". Analyzing its implications and its effective incidence in the country's legal scenario, notably in cases involving hybrid criminal procedural law (materially criminal). Finally, a detailed analysis will be made of the "Beneficial Criminal Retroactivity to Cases prior to the enactment of the law that provides for the ANPP – in the Doctrine, in the Public Ministry (MPF and MPDFT) and in the Jurisprudence (TJDFT, STJ and STF)". Indicating at the end, the solution that seems to be the fairest to the stir, since it is in accordance with the country's legal system, notably the current Federal Constitution, that is, "The Application of the Retroactivity of the Beneficial Criminal Law in Previous Concrete Cases must occur, to the Effectiveness of the Law that Provides for the ANPP, even if the complaint has already been received or if there is already a final and unappealable decision, with the focus on article 5, item XL, CF/88 c/c article 2, §, sole paragraph, of the Penal Code" (Alves, 2022, p. [8]).
